You may upload or post videos, images, text, comments, and other materials (“User Content”). You retain any ownership rights you have in your User Content.
License you grant to Brushr. You grant Brushr a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify for technical formatting, distribute, publicly display, and perform your User Content, solely as necessary to operate, secure, and improve the Service.
You represent that you have all rights needed to submit User Content and that it complies with applicable law and does not infringe others’ rights.
5) Community rules
- Do not post illegal content or content that violates others’ rights.
- No harassment, threats, bullying, hate, or violence.
- No malware, hacking, or attempts to disrupt the Service.
- No impersonation, fraud, or deceptive activity.
- No scraping or reverse engineering except as permitted by law.
6) Optional generation features
The Service may include optional features that generate outputs from your inputs. You are responsible for ensuring you have the rights to use the inputs you provide and that your use complies with these Terms.
7) Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRUSHR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRUSHR TEAM WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRUSHR TEAM’S TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF (A) AMOUNTS PAID BY YOU TO BRUSHR IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $100.
9) Governing law & dispute resolution (binding arbitration)
These Terms are governed by the laws of the jurisdiction of Brushr Team’s principal place of business (without regard to conflict of laws).
Before starting arbitration, you agree to contact us at ebokuhans521@outlook.com to attempt informal resolution.
If not resolved, disputes will be resolved by binding arbitration in English before a neutral arbitrator, administered under the rules of a reputable arbitration provider. The seat/venue will be the jurisdiction of Brushr Team’s principal place of business unless otherwise required by law.
Nothing prevents either party from seeking injunctive or equitable relief to protect intellectual property rights.
10) Changes; termination
We may update the Service or these Terms from time to time. If changes are material, we will provide reasonable notice within the Service. Continued use means you accept the updated Terms.
11) Apple iOS / App Store additional terms
- These Terms are between you and Brushr Team only, not Apple.
- Apple has no obligation to provide maintenance or support.
- Brushr Team (not Apple) is responsible for the app and for addressing claims relating to the app.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the app; to the maximum extent permitted by law, Apple has no other warranty obligation.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
